Terms and conditions of use of special OA agreements for reservations in Barcelona

Purpose of the General Conditions

These General Terms and Conditions are designed to regulate the correct use of discounts and deals that have been agreed upon between Only-apartments and other companies. The purchase of any products and/or services offered constitutes acceptance as a user, without reservations of any kind, of each and every one of these general terms and conditions.

Beneficiaries of discounts/special offers

The recipients of these discounts and special offers are users who book stays in one of the apartments published on the website of Only-apartments in Barcelona during 2015.

Acceptance and availability of the General Terms of Use

By accepting this contract, the user declares:

1. That he/she is a person of legal age and capable of making a reservation.
2. That you have read and agree to these General Terms of Use.

Users-Clients accept the General Terms of Use from the moment they make a reservation through Only-apartments.

User Obligations

In general, the user is obliged to comply with these terms and always act according to the law, morality and the requirements of good faith, due diligence and abstaining from using these special arrangements in any way that may impede, damage or impair the normal operation of the services offered, the property or rights of Only-apartments, its suppliers, its users or, in general, any third party. Access and use of these services by minors without parental consent is not allowed. Only-apartments is not responsible for the accuracy of the data filled in by the user and is therefore unable to verify users’ ages.

Modification of the General Terms of Use

Only-apartments may modify the General Terms of Use, notifying Users-Clients sufficiently in advance, in order to improve services and products offered through Only-apartments. Notification shall mean any modification of the General Terms of Use displayed on the website Only-apartments. In the event that Only-apartments considers such modification may cause harm to any user, it may communicate this by other electronic means it deems appropriate.

In any case, the general terms of use contained herein are mandatory and binding; anyone who does not accept these terms should refrain from using the website and/or services of Only-apartments.

These General Terms of Use do not create any partnership agreement, mandate, or franchise agreement, or employment relationship between Only-apartments and its Users-Clients.

General conditions of the special agreements of Only-apartments

All discounts and special deals offered by Only-apartments in collaboration with other businesses are intended exclusively to customers who book with Only-apartments. They are offers of exclusively personal and non-transferable use and are not redeemable for their economic value or for a product or service other than specified.

Prohibitions

Clients/beneficiaries of agreements of Only-apartments may not:

1. Access services and/or special products without first accepting the General Terms of Use of Only-apartments.
2. Give the offer or discount to a third party. Each offer/discount is personal and non-transferable.

Under no circumstances will Only-apartments, its subsidiaries and/or workplaces, its directors and/or attorneys, employees or, in general, authorized personnel be responsible for any damage, loss, claims or expenses of any kind, whether derived, directly or indirectly, from the use of the services or information acquired or accessed by or through the web.

Only-apartments is not the owner of the goods or services offered and does not have possession of them, but rather acts as an intermediary between Users-Clients and the providers of products and/or services.

Applicable law and jurisdiction

The General Terms of Use shall be governed by and construed in accordance with the laws of Spain.

Special conditions of each provider services / products

The user will have access to information about tourist-related products and services offered through the website of Only-apartments.

• Defective fulfillment or failure to provide services

1. When the consumer determine during use of any of the services that there is a defect or lack of provision of a contracted service, he/she must notify the organizer as soon as possible and, where appropriate, the service provider concerned. The communication must be conducted in writing or in any other manner which leaves a record. After receiving the communication, the organizer must work diligently to find appropriate solutions.

• Inability to provide a significant portion of services by the organizer

1. The partner company must adopt appropriate solutions for the realization of service if once started it fails or determines that it cannot supply a significant portion of the services as provided in the contract.
2. The partner company may not request any supplement for the solutions adopted to complete the service.
3. If the consumer expressly or implicitly accepts the solutions proposed by the partner company, he/she is not entitled to any compensation for such changes. It will be deemed that the proposals have been implicitly accepted if he/she continues to use the service with the solutions given by the organizer.

• Withdrawal of the consumer during the implementation of the activity/product purchase

1. The consumer has the right to dismiss the service or product offered but may not claim the redemption through another product or different service.

• Consumer’s duty to cooperate on the normal development of the services or activities

1. The consumer must comply with the instructions provided by the company for the proper implementation of the service or product acquisition. In particular, for services scheduled as a group, one must give due respect to the other participants and maintain conduct that does not harm the normal development of the activity.
2. The serious breach of these duties empowers the partner company to deny consumer participation in the activity. The company will also be entitled to appropriate compensation for damage attributable to consumer behavior.

Wok to Walk

1 free “menu” at Wok to Walk in the amount of € 9 with the presentation of the corresponding promotional QR code printed in any of its locations in Barcelona. The menu consists of 1 base + 1 favorite (ingredient) + sauce + drink.

Ticketbar

• 1 Walking tour through the Gothic Quarter of Barcelona (valued at € 21).

This tour covers the most iconic and legendary places in Barcelona’s “casco antiguo,” including stops at restaurants and typical terraces.

Approximate duration: 2 hours

Departs daily (5 days a week, from Wednesday to Sunday) at 6 pm. Meeting point: in front of the Hotel Olivia Plaza in Plaza Catalunya.

1 Bottle of free wine to accompany a meal at the Igueldo restaurant (C/Rosello, 186 Ground floor, 08008 Barcelona). The user who wishes to use the CityTab shall:

1. Access the registration URL that is provided at the time of booking through Only-apartments.
2. Enter your personal data in the appropriate form. Once the form has been completed, the customer will receive a code locator that he/she must retain until his/her arrival in Barcelona.
3. After arriving in Barcelona, he/she should contact the offices of Gestiona Apart (Carrer del Pi, 5, Local 22A, Galerías Malda), where someone will request the code locator and the number of a credit card (no charges will be made, as this is just a preventive measure). Once this data has been provided, the tablet will be delivered.
4. The obligation of the client is to use the tablet properly and return it in good condition to the same offices of Apart Gestiona before leaving. You must return it with all accessories (case, SIM card, charger). In no case should it be left in the apartment.

Food Lovers Company

A tour for 1 person valued at € 90 per person for bookings of at least 4 people per apartment. The best selection of tapas and dishes, traditional and popular cuisine in Barcelona. The itinerary offers a real insight into Spanish excellent cuisine, the best quality of fresh product in the most enjoyable and authentic site with a local guide.

The client must send an email to reservas@foodloverscompany.com with your booking number indicating the dates and the number of people. Each tour will leave with at least 3 people. If the minimum number of attendees is not met, the company may cancel the activity.

Palacio del Flamenco

An entry (one person) for one show + one free drink (valued at € 45) for reservations of minimum 2 people per apartment. The client should show the reservation code from Only-apartments at the entrance of Palacio del Flamenco.

Located in the center of Barcelona with a long social and artistic history, the hall has a maximum capacity of 450 people who are comfortably seated for dinner and can enjoy the show in absolute comfort. The show lasts 60 minutes and starts after the attendees have enjoyed dinner.
